Radon Control in New Home Construction: Developments in State Policy

In 2008, the state of Maine enacted legislation establishing a state-wide uniform building code, with mandatory municipal enforcement of the code phased in between 2010 and 2012. 2008 Maine Public Law 699, available at: http://janus.state.me.us/legis/LawMakerWeb/externalsiteframe.asp?

The new law directs the state’s Technical Building Codes and Standards Board to incorporate into the uniform building code the 2009 versions of the international codes, as well as the Maine model radon standard for new residential construction. Maine’s model radon standard, which incorporates ASTM Standard E-1465-06, had been adopted previously as a model to be used by local jurisdictions if the locality chose to adopt radon control requirements for new construction. Between 2010 and 2012, under Maine’s new uniform building code, the state’s model radon standard will become applicable at the local level throughout the state.

The Innovation in Governance Programs work to develop inventive approaches to new or entrenched environmental problems and changing technologies and economies. The programs focus on four objectives:

Investigate and promote innovative approaches to managing government agencies and private businesses that will achieve greater environmental protection.
Safeguard and strengthen the safety net of federal environmental law, its enforcement in the courts, and its state implementation through strategic research, education, and outreach.
Improve understanding of environmental governance tools by hosting visiting scholars and international delegations.
Through ELI’s Center for Business Environmental Strategy, provide information, ideas and tools for corporate environmental lawyers and executives to improve environmental management.
