The Endangered Species Act (ESA) is currently in the spotlight in Washington, D.C. and across the country. One hot ESA topic is the proper use and scope of Section 4(d) rules to mitigate the practical effects of threatened species listings. The recent listing of the Northern Long-Eared Bat, its interim 4(d) rule, widespread public comments, and the final 4(d) rule expected in late 2015 offer a significant case study of this subject.  Our panel of ESA experts from the federal government, industry, the environmental community, and Congress held an informal discussion of the NLE Bat and future of 4(d) rules under the ESA.
