On August 29th, the U.S. Environmental Protection Agency and the Army Corps of Engineers issued a final rule that revised the “waters of the United States” (WOTUS) definition rule. This direct final rule amended the final WOTUS rule previously published in January of this year to be consistent with the Supreme Court’s recent decision in Sackett v. EPA.
