I do not agree that the Federal Energy Regulatory Commission takes a particularly narrow view of the scope of state authority to condition or deny certification under §401(a)(1) of the Federal Water Pollution Control Act. In my opinion, however, an expansive view of §401 is not only wrong as a matter of law but inconsistent with an important goal of the national energy strategy: the encouragement of hydroelectric development.
