Courts Reject Wetlands Takings

Despite the sound and fury claims that wetlands regulations "take" private property and therefore require payment of just compensation under the Fifth Amendment, the vast majority of cases continue to reject this premise. Only three judicial decisions have ever found that federal wetlands requirements have taken private property. All three are trial level decisions.
