A Different Perspective on Section 404

Section 404 of the Clean Water Act, as amended, 33 U.S.C. 1344 (1977), authorizes the Army Corps of Engineers and the EPA to regulate discharges of dredge and fill materials into U.S. waters. However, its fundamental purpose is to encourage alternate technologies, which will enable homebuilding and other worthwhile activities while still maintaining aquatic ecosystem integrity.
