Summary
Region III of the United States Environmental Protection Agency (EPA) has recently begun enforcing Clean Water Act Section 404 requirements as they relate to peat mining. The region has determined that the sidecasting, discing, and harrowing of peat associated with its recovery from a wetland constitutes the redeposition of dredged material within a wetland.
