In October 1988, the United States sued the two Florida agencies responsible for water quality: the Department of Environmental Regulation and the South Florida Water Management District. The amended complaint alleges that the agencies deliver nutrient-laden water to the Everglades National Park and the Arthur R. Marshall Loxahatchee National Wildlife Refuge in violation of water quality standards, state permitting requirements and nuisance law, a license agreement, and a Memorandum of Agreement with the United States.
